Dr M: Cabinet positions based on which party won most seats
Pakatan Harapan component party members that won more seats during the general election will receive more seats in Cabinet, says the Prime Minister. The Cabinet will follow the percentage of seats won during the 14th general election. f the parties don't currently have the correct proportion, the party will get more positions in the full 25-person Cabinet, 
The Cabinet will be no bigger than a 30-person Cabinet.

Formation of the Federal Government

According to Article 43 of the Constitution of Malaysia, The Yang di-Pertuan Agong appointments the Prime Minister and the cabinet. The Constitution states that The Yang di-Pertuan Agong shall appoint a Prime Minister to preside over the Cabinet, who he thinks is likely to command the confidence of most of the MPs.


Appointment of the Prime Minister

The Yang di-Pertuan Agong, acting in his discretion (see Art. 40(2)(a)), first appoints as Prime Minister a member of the Dewan Rakyat who in his judgment is likely to command the confidence of the majority of the Dewan.

However, if a Prime Minister fails to command the confidence of most MPs, he shall resign from the Cabinet.

 

Appointment of other Ministers to form the cabinet

On the advice of the Prime Minister, the Yang di-Pertuan Agong appoints other Ministers from among the members of either House of Parliament.

In the presence of the Yang di-Pertuan Agong, the Prime Minister and his cabinet ministers will then take oath of office and allegiance as well as the oath of secrecy before they can exercise the functions of office.
