The Appointment
On June 4, 2019, it announced that Latheefa Koya would be appointed to replace 
Datuk Seri Mohd Shukri Abdull as the Malaysian Anti-Corruption Commission’s (MACC) chief commissioner.

The Decision
The decision to appoint her was solely made by Prime Minister Dr. Mahathir.  It was reported that the consideration for her appointment was not even discussed with the Cabinet Ministers.

Is Latheefa Koya's Appointment Legal?

Yes. Under the current laws, her appoint is absolutely legal and it is correct that the Prime Minister's has absolute power to decide and make the appointment without consultation with the Cabinet, it is his perogative.

The GE14 Promise

The PH government in its GE14 manifesto pledged to upgrade the anti-corruption commission to the similar independent status of the Election Commission.  The PH government promised to make structural reforms to allow the MACC to report directly to Parliament and not to the prime minister, The PH government also pledged that the appointment of the MACC commissioners and the chief commissioner must be validated democratically by Parliament.

Who is Latheefa Koya?
A simple place to begin would be instituting open competition for all public appointments and appointing ministerial selection committees to shortlist candidates and conduct interviews, says the writer.

What is the Parliamentary Select Committee?

Under the concept of the separation of powers, Parliament cannot interfere with the executive on appointments. "However, as one of the three branches of a democratic government, Parliament is responsible as a check-and-balance to monitor the executive to prevent abuse of power

the bi-partisan committee had previously evaluated and discussed the recent appointments of the Chief Justice, Inspector-General of Police and the Malaysian Human Rights Commissioner.

While the committee had no powers to appoint or reject a candidate, Leong said the committee can ensure that such appointments were merit-based.

"Evaluation by the committee will help validate and instil public confidence in the candidate and that public appointments are based on merit and done with a free mind,"
the setting up of the committee was in line with the Pakatan Harapan's promise to return dignity with regard to key government appointments.
 

What is a Parliamentary Select Committee?

A Parliamentary Select Committee (PSC) is a committee made up of a small number of parliamentary members that are appointed to deal with a particular issue or area of issues. PSCs originate in the Westminster system of parliamentary democracy. 

PSCs ensures a check-and-balance for the practices of the determine subjects. They have the power to request and demand written evidence or call people to testify at
hearings in Parliament. Their findings are published and may be debated in Parliament.
